By using this website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website.

Copyright of Flourish Textile Art Hub teaching  – Intellectual Property Protection Agreement

In order to ensure a respectful and mutually beneficial environment for all participants, we kindly request that you read and acknowledge the following Intellectual Property Protection Agreement. By participating in a Flourish Textile Art Hub workshop or membership programme, you agree to the terms outlined below:

  1. Intellectual Property Ownership: All workshop materials, including but not limited to instructional content, techniques, and any other intellectual property shared during the workshop, are the exclusive property of Flourish Textile Art Hub and Ellie Hipkin artist, or by a named guest tutor.

  2. Non-Commercial Use: By registering for Flourish Textile Art Hub workshop or membership programme, you agree not to engage in any commercial activities related to the techniques, methods, or artwork shared during the workshop. This includes but is not limited to selling artwork commercially, entering art competitions with the UK or internationally. These techniques can’t be reused to teach workshops in-person or online featuring copies of the instructor’s work.

  3. Confidentiality: Participants agree to keep all workshop materials and techniques confidential. This includes refraining from sharing, reproducing, or distributing any information or materials provided during the workshop without the explicit consent of Ellie Hipkin artist.

  4. Non-Compete Clause: Participants agree not to enter into any business activities that directly compete with Flourish Textile Art Hub using the techniques, methods, or intellectual property learned during the workshop.

  5. Legal Recourse: Flourish Textile Art Hub and Ellie Hipkin Art reserves the right to take legal action against any participant found in violation of this agreement.

Online Workshops

  1. You do not need to be members of Flourish Textile Art Hub to book a stand alone workshop.
  2.  When booking a workshop you will have access when stated on the sign up page. Some have instant access, some start on a specific date.
  3. Online workshops have lifetime access or as long as trading. 
  4. Access to workshops are for the individual that purchased the workshop only and not to be shared.
  5. No refunds or credit will be given for the products and services that are purchased and delivered as advertised. This does not affect your statutory rights. 

Membership – 12 month programme. 

1.You can choose to a monthly, 6 or 12 months subscription. The maximum is 12 months.

2. You will be given access to the private Facebook group, and the online members’ area, within 24 hours of signing up.

3. The online members’ area includes the current textile art project, and past projects you have been involved with while being active in the membership. The recording of the monthly zoom call, the creative skills section, and artist interviews.

4. When leaving the membership before the 12 month completion you will lose access to the online projects once your subscription period has expired. 

5. If you are returning to the membership after a break you will gain access to your previous projects. There is no time limit for returning to the membership.

6. Once completing and only for members completing the full 12 month program will have access to the projects for a further 2 months. Giving time to revisit and to complete any outstanding projects. 

Payments, cancellations, pausing and refunds for Flourish members 

1. 6 and 12 month subscription – Once you have signed up, there is a cooling off period of 14 days, in which you can cancel your subscription and receive a full refund. Please contact me by email to action the refund. flourish@elliehipkinart.com

2. After the cooling off period no refunds will be given.

3. Monthly subscription option –  The payment will be taken on the 1st of each monthly until cancelled. You can also change your subscription option at anytime. Please contact me on flourish@elliehipkinart.com

4. Monthly subscription option  – The 14 day cooling off period does not apply, you can cancel at anytime. you’ll have access to the membership until the end of the month you have paid for.

5. 6 month subscription option –  Your membership will automatically renew unless you cancel. We will send you reminders nearer the time to make sure you are happy to continue. Once the payment has been collected no refund will be issued.

6. The 12 month payment option is a one time payment and no further payments will be taken.

7. To cancel your subscription, go to My Account and click on the ‘Subscriptions’ option on the left. This must be completed five working days before the end of the current subscription, to ensure the next payment is not taken. Once the payment has been collected no refund will be issued. You will have access to the membership and to the Facebook group until the end of the subscription period.

8. If you would like to take a break from the membership, you have the option to ‘pause’ your membership after your current subscription period has ended. The option to ‘pause’ will freeze your subscription for 6 months and will protect your subscription from future price increases for the 6 months period. After the 6 months period and the member has not activated the membership the subscription will be considered cancelled.

9. While ‘pausing’ the subscription the member will not have access to the membership projects. Once activating the membership the member will have access to all the previous projects from the previous enrolment.

10. To ‘pause’ your subscription, go to My Account and click on the ‘Subscriptions’ option on the left. This must be completed five working days before the end of the current subscription, to ensure the next payment is not taken.  Once the payment has been collected no refund will be issued. You will have access to the membership and to the Facebook group until the end of the subscription period.

Flourish Graduate Club

1. The Graduate club is offered to members that have completed the 12 month Flourish membership programme. You can join the Flourish Graduate Club at anytime as long as you have completed the full 12 month membership programme.

2. Monthly payments will be taken on the 1st of each month and you can cancel at anytime.

3. The online club’ area includes the 12 membership projects, the growing ‘skilled’ projects section, artist interviews, 2 monthly zoom calls, and access to the private Facebook community. 

4. You can cancel your Graduate club membership at anytime. Go to ‘My Account‘ and click on the ‘Subscriptions’ option on the left to cancel. This needs to be completed 5 working days before the next payment is not taken.

5. You have access to the projects and membership area only while you are a paying Flourish graduate membership. Once cancelling the membership you will loose access at the end of the month of cancelling.

General information about the website

Your access to, and use of, this website, as well as all related websites operated by Ellie Hipkin Art as Flourish Textile Hub, is subject to the following terms and conditions and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect:

You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by of Ellie Hipkin Art trading as Flourish Textile Hub and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sub-licensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Company, as well as other authors who created the materials, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit or use the content of the Site or any Content, including any and all software, tools, graphics and/or sound files, for public or commercial purposes without the express written permission of the Company.

2. All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Site, are copyrighted unless otherwise noted and are the property of the Company and/or a supplier to the Company. No such materials may be used except as provided in these Terms of Use.

3. All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademarks Ellie Hipkin Art and Flourish Textile Hub are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Any unauthorised use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes. Nothing contained in this Agreement or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any Trademark or other proprietary information without the express written consent of the Company or third party owner. The Company respects the copyright, trademark and all other intellectual property rights of others. The Company has the right, but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use. If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify Company at Ellie Hipkin Art at 113 Preston Drove, Brighton, BN1 6EW. Please provide your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.

4. While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.

5. When you register with the Company and/or this Site, you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company. You consent to receive notices electronically by way of transmitting the notice to you by email.

6. If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights thereto), and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise without any acknowledgment or compensation to you.

7. The Company shall use commercially reasonable efforts to restrict unauthorised access to our data and files. However, no system whether or not password protected can be entirely impenetrable. You acknowledge that it may be possible for an unauthorised third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.

Online Store Terms

9. By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

Accuracy, Completeness and Timeliness of Information

10. We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Modifications to The Service and Prices

11. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Services and Returns

12. Our services are available exclusively online through the website. No refunds or credit will be given for the products and services that are purchased and delivered as advertised. This does not affect your statutory rights. You may cancel your membership / club at the end of the subscription period.
We have made every effort to display as accurately as possible the colours and images of our products that appear on the website. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product or service at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Accuracy of Billing and Account Information

13. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Optional Tools

14. We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. In no case shall Ellie Hipkin Art as Flourish Textile Hub, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Termination

22. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website.
